Laws Pertaining to Possession with Intent to Distribute

Arizona laws prohibit the possession of narcotics, prescription drugs, and other dangerous drugs for distribution. If you are found with a quantity of illegal drugs that is more than for personal use, you will be accused of possession with intent to distribute. These laws fall under Title 13 Chapter 34 of the Revised Arizona Statutes.

Generally this means that if the amount found at the time of your arrest consists of the “threshold” amounts described in law, law enforcement will assume that the drugs were intended to be sold or distributed. Each drug has its own threshold amount delineated under law, such as 9 grams of methamphetamine, 1 gram of heroin, and more than 2 pounds of marijuana. Possession with intent to distribute will result in a mandatory prison sentence without the possibility of parole.

Possession with intent to distribute also violates federal drug laws. U. S. Code 21 Section 841 entitled Prohibited Acts describes it as knowingly or intentionally manufacturing, distributing, dispensing, or possessing with the intent to manufacture, distribute, or dispense a controlled substance. The federal law goes on to explain what amounts of specific drugs violate the law, such as 50 grams of methamphetamine. The penalties include 10 years in prison to life with fines starting at $10,000.
