What Are the Penalties for a Second DUI in Arizona?

According to the Arizona Department of Public Safety, “Not many repeat offenders are deterred by broad impaired driving laws.” Because of this, the state has not one, but four alternative sanctioning approaches for individuals who have been convicted of a second or subsequent DUI offense. Each of these have proven to be very effective at reducing repeat DUI offenses in the state. Before we address the four “alternative sanctioning approaches” that apply to repeat DUI offenders, we first want to look at the penalties for a second DUI in Arizona, which include: Second DUI penalties in Arizona:

  • 30 to 90 days in jail
  • A $500 base fine
  • A one-year driver license suspension
  • Ignition Interlock Device (IID)

Now that we have listed the standard penalties for a second DUI in Arizona, let’s take a look at the interventions targeting repeat offenders, otherwise known as “alternative sanctioning approaches” that apply to second DUI offenses:

  1. Impoundment of the defendant’s vehicle, which has been proven to reduce the recidivism rate by about 38%.
  2. Ignition Interlock Device, which is required for all DUI offenders in the state, not just repeat offenders.
  3. Electronic monitoring – this is one alternative to incarceration. This device is placed on the wrist or ankle and assures an offender stays within a certain area.
  4. An early intervention program that involves intensive probation supervision with treatment. This program aims to reduce drunk driving with counseling, monitoring, and addressing the offender’s drinking habits.

The Law on DUI in Arizona

In Arizona, if you’re age 21 or older, you can be charged with DUI if your blood alcohol content (BAC) registers at .08% or above. If you’re commercial driver, the legal limit is .04% and for drivers under 21, the limit is 0.00%. Related: Special Restricted Driver License After DUI
