Arizona’s driving under the influence (DUI) laws are not that different from other states. In Arizona, it’s against the law to drive under the influence of alcohol or any drug. It’s also unlawful to be “in actual physical control” of a vehicle while under the influence of alcohol or any drug, whether it’s an illegal street drug or a lawfully prescribed medication. In Arizona, the offense of DUI is broken down into three categories: DUI, Extreme DUI, and Aggravated DUI. For the purposes of this post, we are going to explain the difference between Extreme DUI and Aggravated DUI. Extreme DUI: An Extreme DUI refers to someone who has a blood alcohol concentration (BAC) of 0.15% or higher. So, it’s like a DUI but on steroids. When a DUI defendant’s BAC registered at or above 0.15%, they face stiffer penalties than they would if their BAC was below 0.15%% The penalties for a simple first DUI include a minimum jail sentence of 10 days, a minimum fine of $1,250, community service, alcohol screening and treatment, and the installation of an Ignition Interlock Device. In contrast, an Extreme DUI is punishable by:
- Community service
- A minimum fine of $2,500
- Alcohol screening and treatment
- A minimum jail term of 30 days with no eligibility of probation.
- The installation of an Ignition Interlock Device
Aggravated DUI: Aggravated DUI is for people who drive under the influence while their license is suspended, revoked, or canceled. It’s also for impaired drivers who have a child under the age of 15 in their vehicle, commit a third DUI offense within 84 months, or refuse to take a BAC test while they are required to have an Ignition Interlock Device. The penalties for Aggravated DUI are as follows:
- Community service
- Up to two years in prison
- Up to one year license revocation
- Alcohol screening and treatment
- The installation of an Ignition Interlock Device
